Terms of Service Agreement – Weekly Pool Service

General Terms and Conditions

Payment Terms

Service is billed at the beginning of the service month and must be paid by the last day of the month to ensure uninterrupted service.

Returned Payment

Returned payments are subject to a minimum $25 bank fee.

Late Charges

Accounts over 30 days past due are subject to a late fee of 10% of the outstanding balance upon each monthly billing until paid in full. 

Collections

Accounts 60 days past due may be sent to collections unless a payment plan has been established.

Cancellation

Service is month to month until terminated by either Party. Client shall give The Pool Managers thirty (30) days advance written notice of Client’s intent to terminate service.

Service Day

Customer will be assigned a specific service day and a 2 to 4 hour window on that day.  Unless otherwise notified by the service technician, weekly service will be performed during that window. Requests to service the pool on a different day or time are subject to an additional service visit fee.

Repairs

Minor repairs of $50 or less will be completed as a matter of routine maintenance. Repairs over $50 will be communicated to customer for approval or referral.

Annual Mineral Treatment

All service levels require an Annual Mineral Treatment in late spring or early summer for all customers. The cost of the treatment is $85 to $100, depending on the size of the pool.

Filter Cleanings

If filter cleanings are included in the service level, there is no additional cost. For Chemical Only customers, filter cleanings are subject to an additional cost depending on the filter type/size.

Extreme Weather

In the event of inclement weather on scheduled date of service, service will be provided only to the extent weather permits. Service will be rescheduled if necessary.

Holidays

New Year’s Day, Independence Day, Memorial Day, Labor Day, Thanksgiving Week and Christmas week. Service will be rescheduled if necessary.

Vacations

Technicians take up to 2 vacation weeks per year and vacations are built into our pricing. Customer will be notified when necessary and no adjustments will be made to billing.

Disclaimer

The Pool Managers shall not be responsible for any damage to property due to acts of nature, fire, vandalism, misuse, or abuse. Customer should be aware of normal deterioration of equipment that occurs over time due to exposure to chemicals, sunlight, or any other corrosive materials (i.e. salt) that may enter the pool. Also, The Pool Managers is not responsible for any damages or deterioration caused by failure of a Customer to perform other services recommended by The Pool Managers, or by failure of Customer to properly maintain the pool and equipment between visits.


Customer Responsibilities

Water Level

Customer is responsible for always maintaining proper water levels.

Pump Run Time

Customer is responsible for making sure the pool pump runs a sufficient amount each day as recommended by The Pool Managers.

Pool Parties / Heavy Usage

Customer is responsible for shocking the pool after pool parties or heavy pool usage.

Communications

Customer must be responsive to communications from service technician or office.

Leaks

Customer is responsible for resolving leaks that cause excessive water loss/replacement. For pools with ongoing leaks there will be an annual rebalancing fee.

Drainage

Green, brown, or cloudy pools caused by heavy rain and improper landscape drainage are subject to additional cleanup cost including extra chemical treatments, filter cleanings and service calls.

Ducks / Wildlife

If ducks or other wildlife are living in the pool, there may be additional charges for extra cleanup efforts and/or chemical treatments.

Toys

Customer is responsible for removing toys from the pool when the pool is not in use to allow proper filtration and pool cleaner functionality.

Fountains / Waterfalls

Customer is responsible for either running the fountain/waterfall every day OR if not used every day, cleaning the fountain/waterfall reservoirs out and chemically treating them before use.  If algae or heavy debris are allowed to build up and enter the pool upon use, additional treatments or cleanup charges may be necessary.

Pets

For insurance and and safety purposes, we don't service pools with large and/or aggressive dogs on the property unless they are securely contained in an area separate from the pool and there is verifiably safe access to the pool and the pool equipment. Customer is responsible for notifying us if there are large and/or aggressive dogs that are or will be on the property, and for making sure they are properly contained during all service visits. Upon any incident where a service technician is confronted, charged, or attacked by a dog, service will be subject to immediate termination.

Safety

Customer is responsible for maintaining local code compliance on issues such as gates, fencing, and any other applicable safety issues.

Pool Access

Customer is responsible for making sure pool and pool equipment are easily accessible to service technician on the assigned service day and time. Locked gates should be unlocked at time of arrival. Service technicians will not knock on door or try to contact customer to unlock gate. If necessary, chemicals may be left on the property and customer notified with application instructions. No refunds will be given if pool is not accessible. If pool accessibility becomes a persistent problem service will be subject to termination or additional charges for cleanup efforts.

Baskets / Bags

Customer is responsible for emptying skimmer baskets, pump baskets, and pool cleaner bag as needed in between weekly service.

Pool Filter

Chemical Only customers are responsible for cleaning the main pool filter as needed throughout the year as recommended by The Pool Managers.

Debris in Pool

For customers who do not subscribe to Full Service, customer is responsible for removing debris from the pool each week as needed to avoid excessive organics from sitting in the pool for long periods of time.

Plants Growing in Pool

Customer is responsible for ensuring plants and trees are not growing into the pool water.

Upon breach of any of the Customer Responsibilities, customer may be subject to additional charges for service calls, additional services and/or additional chemical treatments, or service cancellation.
